OutfitGrader AI Terms of Service
Effective Date: July 27, 2025
Please read these Terms of Service (“Terms”) carefully before using the OutfitGrader AI mobile application (the “App”), operated by Velpuri Enterprises Inc. (“we,” “us,” or “our”). By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.
1. Acceptance of Terms
Your access to and use of the OutfitGrader AI App is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.
2. App Usage and Access
OutfitGrader AI provides users with AI-powered style analysis and recommendations based on uploaded outfit photos and onboarding preferences. Your access to certain features of the App may require an active subscription.
3. User Conduct
You agree not to use the App for any unlawful purpose or in any way that could harm us, our users, or any third party. Specifically, you agree not to:
- Upload any content that is offensive, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable.
- Upload content that infringes upon the intellectual property rights of others.
- Attempt to gain unauthorized access to the App’s systems or networks.
- Interfere with or disrupt the integrity or performance of the App.
- Use the App for any commercial purpose without our express written consent.
- Misrepresent your identity or impersonate any person or entity.
4. User Content
The App allows you to upload outfit photos (“User Content”) and provide onboarding answers regarding your style preferences, gender, and age. You retain ownership of any intellectual property rights that you hold in that User Content. By uploading User Content to the App, you grant Velpuri Enterprises Inc. a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content solely for the purpose of operating, providing, and improving the OutfitGrader AI App and its services (e.g., to perform AI analysis and provide style recommendations). This license will terminate when you delete your User Content from the App or delete your account.
You are solely responsible for the User Content you upload and its legality, reliability, and appropriateness. We are not responsible or liable for the deletion or accuracy of any User Content, or for the failure to store, transmit, or receive transmission of any User Content.
Intellectual Property, Purchases, Deletion
5. Intellectual Property
The App and its original content, features, and functionality are and will remain the exclusive property of Velpuri Enterprises Inc. and its licensors. The App is protected by copyright, trademark, and other laws of both Canada and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Velpuri Enterprises Inc.
6. In-App Purchases and Subscriptions
The App offers in-app purchases and auto-renewable subscriptions to access premium features. These purchases are processed through Apple’s App Store. By making a purchase, you agree to the terms and conditions of Apple’s App Store, as well as these Terms.
- Payment Processing: All payments are handled by Apple’s App Store. We do not process or store your credit card information.
- Auto-Renewal: Subscriptions will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.
- Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your Apple ID Account Settings after purchase.
- Refunds: Refunds for in-app purchases are subject to Apple’s App Store refund policies. We cannot directly issue refunds for purchases made through the App Store.
Your use of the OutfitGrader AI App is also governed by Apple’s Licensed Application End User License Agreement (EULA). In the event of a conflict between these Terms and the Apple EULA, the Apple EULA shall prevail regarding your use of the App purchased from the Apple App Store.
7. Account Deletion
You can delete your account and all associated User Content and data directly within the App’s settings. Upon deletion, your data, including your uploaded Outfit Photos and onboarding answers, will be permanently removed from our Supabase database.
Disclaimers, Liability & Law
8. Disclaimer of Warranties
Your use of the App is at your sole risk. The App is provided on an “AS IS” and “AS AVAILABLE” basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
Velpuri Enterprises Inc. does not warrant that the App will function uninterrupted, securely, or be available at any particular time or location; that any errors or defects will be corrected; that the App is free of viruses or other harmful components; or that the results of using the App will meet your requirements.
9. Limitation of Liability
In no event shall Velpuri Enterprises Inc., nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
10. Indemnification
You agree to defend, indemnify, and hold harmless Velpuri Enterprises Inc. and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses, resulting from or arising out of your use of the App, breach of terms, or User Content posted.
11. Governing Law
These Terms shall be governed and construed in accordance with the laws of Ontario, Canada, without regard to its conflict of law provisions.
Changes and Contact
12. Changes to These Terms
We reserve the right to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days’ notice prior to any new terms taking effect. By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms.
If you do not agree to the new terms, please stop using the App.
